Demand that the Department of Justice Investigate Kavanaugh's False Statements to the Senate!

To: U.S. Department of Justice
CC: Members of the Senate Judiciary Committee

Throughout the September 2018 confirmation hearings for Supreme Court nominee Brett Kavanaugh, it became clear that he had repeatedly provided inaccurate and perhaps deliberately misleading statements to the Senate Judiciary Committee to get confirmed to his current job as a judge on the D.C. Circuit.

In light of the evidence that Kavanaugh provided false or misleading testimony to the Senate under oath, we urge the U.S. Department of Justice to fully investigate Kavanaugh's statements to determine whether any laws were broken. This investigation must occur before the Senate votes on whether to confirm Brett Kavanaugh to the Supreme Court.

In 2004 and 2006, as nominee to the U.S. Court of Appeals for the District of Columbia Circuit court, Brett Kavanaugh repeatedly and unequivocally denied that he ever received stolen materials in the early 2000s during his time at the Bush White House. The materials in question were stolen from Senate Judiciary Committee Democrats as they drafted plans for their strategy for judicial nominees put forward by then President Bush.

During the September 2018 confirmation hearings for now Supreme Court nominee, Brett Kavanaugh, emails were uncovered that outright contradict his previous testimony to the Senate. This brazen attempt to hide the extent of Brett Kavanaugh's knowledge of the stolen materials is highly unethical for any judicial nominee, let alone a nominee for Supreme Court justice!

This deliberate attempt to hide the full extent of Kavanaugh's receipt and handling of stolen materials deserves a full investigation by the U.S. Department of Justice and must be conducted prior to any vote on whether to confirm Brett Kavanaugh.

A lifetime judicial appointment to our nation's highest court deserves the fullest scrutiny possible -- especially if the nominee has potentially lied under oath to the Senate -- an egregious assault on our nation's judicial system.
