Judicial review, the idea that our court system can provide a “check” on the abuse of executive or legislative powers, is a concept nearly as old as our country. It protects all of us from tyranny and is a cornerstone of our democracy.
In a dramatic betrayal of this foundational principle, this weekend Vice President JD Vance posted on social media that “Judges aren't allowed to control the executive's legitimate power.” But the critical piece missing from this statement is that judges do get to decide what that legitimate power is. That’s part of our constitutional framework. Vance’s assumption that all power lies with the president is absolutely wrong. Checks and balances, between our branches of government, are crucial to protecting our democracy. We must ensure this principle stands strong in the face of Trump’s authoritarianism.
